Gor Mahia fined KSh 300k over matchday security breach at Kasarani

Nairobi, Kenya — The Football Kenya Federation (FKF) Disciplinary Committee has fined Gor Mahia FC KSh 300,000 and issued a formal warning following a security breach during their FKF Premier League match against Bidco United at Kasarani Stadium on September 21, 2025.

In a statement released on Friday, 31 October, the FKF Disciplinary Committee found that Gor Mahia had breached both FKF Regulations and the CAF Disciplinary Code, despite the club’s use of third-party vendors for ticketing and access control.

The committee emphasised that the club has a non-delegable duty of care to ensure safety, order, and effective supervision during official fixtures.

The ruling reaffirmed two key legal principles – Strict Liability and Vicarious Liability – which hold clubs responsible for any incidents occurring in or around the stadium, even without direct fault, and extend that responsibility to actions or omissions by contractors and service providers.

“Outsourcing operational functions does not absolve a club from its responsibilities,” the Committee stated, noting that both CAF and FIFA frameworks require proper oversight and preventive measures from clubs at all times.

As part of the sanctions, Gor Mahia has been found culpable of failing to maintain adequate security and order during the September fixture.

In addition to the monetary fine, the club received a formal warning to enhance matchday safety protocols and ensure compliance with federation standards.

The committee cautioned that any future lapses of a similar nature would attract harsher penalties, potentially including stadium bans or points deductions.

A detailed Reasoned Decision outlining the legal findings will be released on 4 November 2025, after which Gor Mahia will have the right to appeal under the FKF Rules and Regulations (2024).

The decision serves as a stern reminder to all top-flight clubs that responsibility for fan safety and stadium security ultimately rests with them, regardless of the operational arrangements they put in place.
