A former police constable has been sentenced to 15 years in prison for defiling a minor at Makutani village in Baringo County on July 7, 2022.

The officer is said to have lured the minor to a police camp where he violated her. In her ruling, Honourable Purity Kosgey of the Kabarnet Law Courts stated that the prosecution, led by Sydney Koech and Moses Ng’ang’a, proved the case beyond reasonable doubt.
“I find the prosecution proved the guilt of the accused person beyond reasonable doubt. He is found guilty of defilement contrary to Section 8(1)(4) of the Sexual Offences Act and is convicted under Section 215 of the Criminal Procedure Code,” she ruled.
The minor testified that on the morning of July 7, 2022, her mother was arrested after a fight. Around 4 p.m., the accused, a police constable attached to Mukutani Police Post came to their home.
He claimed her mother had instructed her to sleep at their home. This raised suspicion since she usually stayed at a neighbour’s house when her mother was away. Later that evening, the accused returned and offered to bring her meat if she agreed to stay alone at home and wait for him.
He then left for a nearby bar. The minor chose to go to her cousin’s house instead, intending to spend the night there. Her cousin later returned and told her that her mother had allegedly asked them to take their child to the police station for breastfeeding, and they left together.
More details emerge
On their way, they encountered the accused, who confronted the minor, saying he had been looking for her. This continued until they reached the police station gate.
The accused sent the cousin away and took the minor inside the camp while she held the child. He led her through different areas within the station, claiming her mother was in a tunnel, although she was not.
When the minor expressed her desire to go home, the accused grabbed her, stripped her, and assaulted her.
The minor returned to her cousin’s home, bleeding, and told her what had happened. They reported the matter that night, and she received medical care.
The following day, the accused was arrested. Medical evidence showed that the minor had been sexually assaulted and had infections consistent with defilement.
The prosecution also presented seven witnesses whose testimony detailed the events leading to the accused’s arrest.
The accused person’s defense
In his defense, the accused denied the allegations and claimed he was being framed to prevent the case against the minor’s mother from going to court.
Honourable Kosgey found this defense unreliable given the strong, consistent evidence from the prosecution.
The court noted that none of the witnesses had a grudge against the accused, and the sequence of events ruled out any conspiracy to frame him.
This comes as the world just concluded marking 16 days of activism against gender –based violence which began from November 25 to December 10, 2025.
