Why High Court allowed Sarah Wairimu to attend Tob Cohen’s burial

The High Court on Monday morning issued an order
allowing the main suspect in the murder case of the Dutch tycoon Tob Cohen to attend
his burial.

Sarah Wairimu, Cohen’s wife, will be escorted by
Lang’ata OC to the Jewish cemetery along Wangari Maathai road to attend her
husband’s burial at 2 pm.

According to the High court judge Stellah Mutuku,
both parties had agreed to allow Sarah attend the burial.

“This court is pleased to issue a production order
to the OC Lang’ata Women’s Prison, to produce and escort the applicant to
Jewish cemetery to attend the funeral of the late To Cohen.” said Lady Justice
Mutuku.

Reason

Cohen’s family lawyer Cliff Ombeta confirmed that
this is the first time a murder suspected is allowed to attend the burial of
the victim in Kenya.

He said that there is no need of engaging in fresh
woes and legal tussle over the dead.

“We agreed on this matter on September 19 before it
was filed. There is no property in a corpse.” said Mr. Ombeta.

Sarah’s lawyers George Ouma and Philip Murgor also
confirmed that they had held a meeting and agreed that she will be allowed to
attend.

They added that ‘it is not harmful or prejudicial’
for Sarah to attend the burial of her late husband.

Ombeta further cleared doubts over Cohen’s sister
attendance, saying she flew out of the country ‘to attend to urgent issues back
home’.

He added that Cohen’s brother will preside over the
burial, since according to the Jewish tradition, ‘a brother buries the brother’.

Tob Cohen’s body was found in a septic tank in his
compound in Nairobi nearly more than a month after he went missing.
